TOWN AND COUNTRY PLANNING ACT, 1990 (AS AMENDED) - TOWN AND COUNTRY PLANNING (GENERAL DEVELOPMENT PROCEDURE) ORDER, 1995 - DEVELOPMENT APPLICATIONS GENERALLY To consider
the Head of Planning’s Report No. PLN1618 on planning applications recently
submitted to the Council (copy attached with a copy of the index appended to
the agenda). Minutes: RESOLVED: That (i) Permission be given to the following application set out in
Appendix “A” attached hereto, subject to the conditions, restrictions and

applications dealt with by the Head of Planning, where necessary in
consultation with the Chairman, in accordance with the Council’s Scheme of

REPRESENTATIONS BY THE PUBLIC To consider

cases of planning enforcement and possible unauthorised development. Minutes: In accordance with the

were made to the committee and were duly considered before a decision was
reached:

APPLICATION NO. 16/00263/FULPP – 31 READING ROAD, FARNBOROUGH To receive
the Head of Planning’s Report No. PLN1619 (copy attached) on the progress of
recent planning appeals. Minutes: The Committee received the Head
of Planning’s Report No. PLN1618 (as amended at the meeting) regarding the
erection of a terrace of four three-bedroom three-storey dwelling houses and
associated parking following the demolition of the existing bungalow. It was noted that the
recommendation was to grant planning permission, subject to the completion of a
satisfactory planning obligation under Section 106 of the Town and Country
Planning Act, 1990. RESOLVED: That (i) subject to the completion of a satisfactory Agreement under
Section 106 of the Town and Country Planning Act 1990, by 20th June, 2016, to
secure appropriate financial contributions towards transport and SPA
mitigation, the Head of Planning, in consultation with the Chairman, be
authorised to grant planning permission, subject to the amended conditions and informatives set out in the Head of Planning’s Report No.
PLN1618; however (ii) in
the event that a satisfactory Section 106 Agreement is not received by 20th
June, 2016, the Head of Planning, in consultation with the Chairman, be
authorised to refuse planning permission on the grounds that the proposal does
not make satisfactory provision for transport contributions in accordance with
the Council’s adopted ‘Transport Contributions’ SPD and Core Strategy Policies
CP10, CP16 and CP17; and financial contribution to mitigate the effect of the
development on the Thames Basin Heaths Special Protection Area in accordance
with the Rushmoor Thames Basin Heaths Special
Protection Area Interim Avoidance and Mitigation Strategy Policies CP11 and
CP13. |

RUSHMOOR LOCAL ENFORCEMENT PLAN Minutes: The Committee received the Head
of Planning’s Report No. PLN1617 which included a copy
of the draft Local Enforcement Plan. It was noted that
Government advice in the National Planning Policy Framework (NPPF para. 207)
was that Councils should make a clear statement of their approach and
commitment to the enforcement of planning control in a Local Enforcement Plan.
This should provide a firm decision-making framework for effective enforcement
procedures to be put in place. RESOLVED: That the draft Local Enforcement Plan be referred to the Cabinet for adoption and publication. |
